Commonwealth v. J.S.

Our client was convicted of aggravated assault and sentenced to a lengthy term of incarceration.  After the sentence was imposed, we learned that the Commonwealth had previously offered a negotiated plea to our client before trial, but prior counsel did not inform or advise our client about this.  We filed a PCRA petition and alleged that prior counsel was ineffective.  After extensive briefing and being ready to present multiple witnesses, on the day of the hearing the Commonwealth chose not to proceed and instead re-offered the pre-trial deal to our client.  The result was a substantial reduction in our client’s sentence.”
