In this case our client received a sentence in federal court for a white collar crime. His prior counsel did not file an appeal, though the client asked for an appeal to be filed. We filed a federal habeas corpus petition and alleged that prior counsel was ineffective for failing to perfect the appeal. After an evidentiary hearing where the client and his wife testified and we introduced relevant phone records, and in which we extensively cross examined prior counsel, the federal judge agreed with our position and granted our petition. The client’s appeal rights have been reinstated so that his appeal can be litigated.
